1. Scope and Service Content

These General Terms and Conditions (GTCs) apply to all legal relationships between the guide and the guests, even if not explicitly referenced. The services provided by the guide are based exclusively on these GTCs. The agreement between the guide and the guest includes the guide’s obligation to lead the guest on a specific tour, while the guest is obligated to pay the agreed fee, unless a free service has been explicitly agreed upon.

The participation requirements listed in the programs or tour descriptions must be met by the guest. Guests are responsible for the condition and maintenance of their equipment as well as their physical fitness. Truthful information regarding suitability for participation must be provided to the guide and organizer. It is recommended to consult a physician beforehand to confirm health suitability. By booking, the guest acknowledges the risks associated with alpine activities and agrees to assume these risks personally.
The guide will check the guests’ equipment before the tour to ensure it meets the requirements. The guide reserves the right to exclude participants if their equipment is inadequate or if they are deemed unfit for the challenges of the tour. In such cases, no refund will be issued.

While every effort is made to plan tours carefully, no guarantee can be given for achieving the intended goal or summit. Decisions regarding the route, breaks, use of equipment (e.g. ropes, crampons, ice axes) and continuation or cancellation of the tour lie solely with the guide. No claims can be made if a tour cannot proceed due to safety concerns or the guest’s negligence.
Guests are responsible for any damages or repair costs for borrowed equipment exceeding normal wear and tear. To ensure safety, guests are required to follow the guide’s instructions. The guide accepts no liability for any consequences resulting from non-compliance.

2. Contract Conclusion
​
A contract between the guest and the guide or organizer is concluded when there is agreement on the essential terms (objective, fee, timing, number of participants). Bookings can be made written, verbally or via email with telephone bookings also being legally binding.
If a booking is made for multiple participants, the person making the booking is liable for the full payment.
The guide reserves the right to modify training or tour programs due to unforeseen circumstances. Weather conditions or other unforeseeable factors may require changes to the tour. The right of withdrawal under the Distance Selling Act does not apply, as the service is provided at a fixed date in the leisure sector.

3. Participant Substitution
​
If a guest cannot attend, they may transfer their booking to another person, provided that this person meets all participation requirements and notifies the guide or organizer in a timely manner. The original guest and the substitute participant are jointly liable for payment of the fee and any additional costs. The guide reserves the right to decline substitutions for valid reasons.

4. Minimum Participants
​
Events are only conducted if the specified minimum number of participants is reached. If this number is not met, the guide may withdraw from the contract up to 7 days before the event. Any fees already paid will be refunded. Upon request, the guide can provide a revised offer with adjusted pricing.

5. Insurance
​
The guide holds the legally required liability insurance. All other insurance (e.g. accident insurance) must be arranged by the guest. Guests are advised to secure insurance covering rescue costs, as helicopter or mountain rescue operations can incur significant expenses not covered by social insurance. Participation without accident or rescue insurance is at the guest's own risk.

6. Warranty
​
Guests are entitled to warranty claims for non-performance or defective performance. Efforts will be made to rectify any issues, where possible. No claims can be made for service disruptions caused by the guest (e.g. health problems).

7. Liability
​
The guide is liable for breaches of contractual duties within the scope of their legal liability insurance. Liability is limited to gross negligence and intent. Claims for minor negligence or loss of enjoyment are excluded.
Participation in tours is at the guest's own risk and they must exercise caution. Guests assume responsibility for the inherent risks of alpine activities, including avalanches, falls or altitude sickness. The guide is not liable for accidents resulting from these risks.

8. Guest Cancellation
​
Guests may cancel the contract at any time with written notice required. Cancellation fees apply as follows:

Up to 40 days before start: no fees

Up to 30 days before start: full refund minus € 100 admin fees

29–15 days before start: 50 % of the agreed price

14–7 days before start: 75 % of the agreed price

Less than 7 days before start: 100 % of the agreed price
Non-refundable third-party services or planning costs incurred by the guide are the guest’s responsibility. Cancellation fees for accommodations (e.g. hotels or huts) must also be borne by the guest. Travel cancellation insurance is recommended. Rescheduling is treated as cancellation and rebooking.

9. Guide Cancellation
​
The guide may withdraw from the contract if unforeseen events (e.g. natural disasters, government orders) prevent the tour. In such cases, the guest will be charged only for incurred expenses.

10. Data Protection and Use of Media
​
The guide is entitled to store and share personal data for contract execution. By participating, guests agree to the use of photos and videos taken during the tour for promotional purposes. Guests can opt out of this use at any time. Personal data will be stored in compliance with legal retention requirements.

11. Cookies
​
This website uses cookies—small text files stored on the user’s device that enable recognition on subsequent visits. Cookies can be managed or disabled via browser settings, although this may limit functionality.

12. Web Analytics
​
This website uses Google Analytics to analyze user activity. Data collected by cookies (including IP addresses) is processed by Google in the U.S. Users agree to this data usage by continuing to use the website.

14. Final Provisions

Austrian law applies. Should individual provisions be invalid, the remaining provisions remain unaffected.
